Terms and Conditions - Store Terms

The following terms and conditions are incorporated into and form part of the saamayamarketplace.com Terms of Use. Unless otherwise defined herein, capitalized terms shall have the meaning assigned to them in the Terms of Use. Any violation of the terms below will be considered a material violation of the Terms of Use.

1. Shops and materials.

Multiple URLs that point to the same content on the home page are considered a single Store. A Store can be individually configured with its own settings, payment methods, and third-party apps.

2. You are solely responsible for your Stores and Equipment. "Laws" means the applicable laws, rules and regulations; "Your Materials" means the content, communications, text, images, videos, photographs, domain names and all other materials published, displayed or linked from your stores; "Your Users" means your customers, customers, subscribers, guests, visitors and guests of your Stores.

2. Compliance.

You will require Your Users to comply with (and not allow them to violate) all Laws and these Conditions. All products and services accessible through your Stores and Materials will comply with all laws, including, but not limited to, the Accessibility Laws. You will respond quickly to and resolve all accessibility complaints.

4.Remedies.

Without limiting its rights and remedies, saamayamarketplace.com reserves the right, at its discretion, to suspend or terminate access to your Account and your subscription to the Services, with or without notice, and to take any other action saamayamarketplace.com deems necessary at its discretion to prevent or remedy any violation by you or your Users of the Terms.
b. Deleting content. Although saamayamarketplace.com has no obligation to monitor your Stores (as defined in the Store Terms) or Materials, saamayamarketplace.com may do so and may remove any of your Stores or Materials that it believes to be (or are likely to be) in violation of any Law or the Terms, or are otherwise objectionable or offensive in the sole discretion of saamayamarketplace.com.

5. Cooperation with law enforcement.

Where required by law, or otherwise at the discretion of saamayamarketplace.com, saamayamarketplace.com will cooperate with law enforcement agencies in any investigation of an alleged activity related to your documents, your users and your use of the website or services.

3. Communications.

You are solely responsible for all communications between you and your users. You represent, warrant and warrant that all email communications between you and your users using the Services will be in accordance with your privacy policy and all laws, including, without limitation, all laws relating to unsolicited email, privacy, obscenity and defamation.

4. Property and litigation.

5. Suspension/Termination. If you are unable to resolve the dispute within a reasonable time, as determined by SamayaMarketPlace.com at its discretion, SaamayaMarketPlace.com may suspend or terminate your Account and/or Stores until such time as this dispute is resolved conclusively.

6. Judicial determination. If a third party is identified by court order, binding arbitration or settlement agreement as the legitimate owner, SaamayaMarketPlace.com may, without any liability to you, transfer ownership of your account and/or stores to the identified owner.

5. Design Themes.

1. License. SaamayaMarketPlace.com you grant, as long as you continue to subscribe and pay for the Services, a worldwide non-exclusive, revocable and worldwide license to modify, make derivative works and use, each licensed design theme only in conjunction with your creation of Stores/Websites on the SaamayaMarketPlace.com platform using the Services. The design themes are the exclusive property of SaamayaMarketPlace.com or our design licensor, and all rights, titles and interests in each design theme exclusively restrict the property of SaamayaMarketPlace.com or the applicable design licensor. Design themes include all styles associated with licensed design themes.
2. Several stores. This license only allows you to use each licensed design theme for a single store/website per license purchased. If you want to use a design theme for more than one Store/website, a new design theme license must be purchased for each Store that uses the design theme.
3. Non-exclusive. All design themes are under non-exclusive license and may be reproduced and redistributed an unlimited number of times by SamayaMarketPlace.com
4. Transfer. Design Themes may only be used by you and may not be transferred by you to an unaffiliated third party without the prior written consent of SaamayaMarketPlace.com in each case. For greater clarity, you may not license, sublicense, assign, transfer, redistribute or sell design themes or derivative works thereof to any third party
5. Support. If you license a design theme for your website, SaamayaMarketPlace.com may provide your personal information to our design licensor to facilitate the provision and/or offering of support/services and/or products for you. Technical support for a design theme is the responsibility of the designer's licensor, and SaamayaMarketPlace.com accepts no responsibility for providing such support. If you customize a design theme through a tool other than the theme editor or style editor, the design licensor may refuse to offer a price to support that design theme.
6. Installation. It is your responsibility, not that of SamayaMarketPlace.com, to ensure that the installation of a new design theme does not overwrite or damage your current or pre-existing theme, or your user interface.
7. No refund. Unless otherwise specified in the order when licensing a design theme, you will not be reimbursed for design themes once purchased.
8 Some services.
- 1. Migration services. SaamayaMarketPlace.com offers migration services to customers who purchase certain service plans (as described on our website) or for an additional fee. SaamayaMarketPlace.com supports most standard default shopping cart database schemas. Our Migration Services do not guarantee the proper migration of custom data, fields or information by third party modules and/or contributions. We recommend that the data be migrated to a Store that is not active (visible to the public and/or in-process). If, for any reason, you need migration services to transfer data to an online store, we recommend placing your store in “maintenance mode” during data transfer, as importing large amounts of data can disrupt business flow within an online store site.
- 2. Integration services. Our integration services include the configuration of the basic parameters of the SaamayaMarketPlace.com store and are available to customers purchasing certain service plans (as described on our website) or for an additional fee.
9. No refund. Unless included in a selected service plan, migration services and integration services are services for which we offer one-time, additional, non-refundable fees.
